Terms of Service

ZenPogo Bowl — ZenPogo Sports LLC

1. Acceptance of Terms

By downloading, installing, or using ZenPogo Bowl (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and ZenPogo Sports LLC ("Company," "we," "us," or "our").

2. Description of the App

ZenPogo Bowl is a mobile bowling scoring and mindset application available on iPhone and Android, with an Apple Watch companion app available for iPhone users. The App divides a bowling game into four blocks of three frames, provides simplified score entry, and delivers motivational affirmations between blocks to support competitive focus and mental performance.

3. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are between 13 and 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.

4. License Grant

Subject to your compliance with these Terms, ZenPogo Sports LLC grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on your personal devices solely for your personal, non-commercial purposes. If you access the Apple Watch companion, that companion app is licensed only for use with a compatible iPhone.

5. Restrictions

You agree not to:

  • Copy, modify, or create derivative works of the App
  • Reverse engineer, decompile, or disassemble the App
  • Remove or alter any proprietary notices or labels
  • Use the App for any unlawful purpose or in violation of any applicable regulations
  • Attempt to gain unauthorized access to any portion of the App or its related systems
  • Use the App in any manner that could damage, disable, overburden, or impair our services

6. Intellectual Property

The App and all its content, features, and functionality — including but not limited to text, graphics, logos, icons, affirmations, audio clips, and software — are the exclusive property of ZenPogo Sports LLC and are protected by applicable copyright, trademark, patent, trade secret, and other intellectual property laws.

"ZenPogo Bowl," "ZenPogo Sports," and associated logos are trademarks of ZenPogo Sports LLC. You may not use our trademarks without our prior written permission.

7. No Account Required

ZenPogo Bowl does not require account creation. All game data is stored locally on your device. We do not maintain user accounts or profiles on our servers.

8. In-App Purchases

The current version of ZenPogo Bowl does not offer in-app purchases or subscriptions. If future versions introduce paid features, those transactions may be processed by Apple through the App Store, Google through Google Play, or another authorized distribution platform, and will also be governed by the applicable platform's payment terms. We will update these Terms accordingly.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, ZENPOGO SPORTS LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
  • THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED
  • THAT THE APP OR ITS CONTENT IS SUITABLE FOR ANY PARTICULAR PURPOSE, INCLUDING ATHLETIC TRAINING OR COMPETITION

The affirmations and motivational content provided in the App are for general wellness purposes only and do not constitute professional sports coaching, psychological counseling, or medical advice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ZENPOGO SPORTS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) TEN DOLLARS ($10.00).

11. Indemnification

You agree to indemnify, defend, and hold harmless ZenPogo Sports LLC and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with your use of the App or your violation of these Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the App that cannot be resolved informally within 30 days of written notice shall be resolved exclusively in the state or federal courts located in Pennsylvania, and you consent to the personal jurisdiction and venue of those courts. Either party may seek injunctive relief in a court of competent jurisdiction for intellectual property matters.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date at the top of this document and, where appropriate, via in-app notification. Your continued use of the App following the posting of revised Terms constitutes your acceptance of those changes.

14. Termination

We may suspend or terminate your license to use the App at any time, without notice, for any reason, including your violation of these Terms. Upon termination, your license to use the App will immediately cease. Sections 5, 6, 9, 10, 11, and 12 survive termination.

15. Third-Party Services

The App may rely on third-party services and platform features, including Apple and Google mobile operating system services, Apple WatchConnectivity for the Apple Watch companion, and Sentry for crash reporting and diagnostic monitoring when enabled by our production configuration. We are not responsible for the availability, content, or practices of third-party services, and we encourage you to review the terms and privacy policies of those providers.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ZenPogo Sports LLC regarding the App and supersede all prior agreements and understandings relating to its subject matter.
